OAKLAND (KDKA) – An Oakland Pizza shop owner charged with dealing drugs out of the shop was in court today, but his case was transferred to another jurisdiction.

His attorney, Patrick Thomassey, said because the case was erroneously filed with a Penn Hills magistrate, he could have successfully argued to dismiss the case.

However, Thomassey believes the charges would have been refilled and his client, Fadi Aboud, would have been arrested again. The case has now been transferred to city court.

Aboud is charged with dealing cocaine, marijuana and OxyContin pills out of Larry and Carol’s Pizza shop on Semple Street. The Allegheny County District Attorney vowed to have the establishment shut down as a nuisance property.

Thomassey, though, hopes prosecutors will not pursue that option.

However, District Attorney Spokesperson Mike Manko said his office fully intends to pursue the nuisance proceedings and is still reviewing the case.
